Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pretense's software, services, and website (collectively, "Services"). By using our Services you agree to be bound by these Terms. If you are using our Services on behalf of an organization, you represent that you have authority to bind that organization.

1. Definitions

• "CLI": The pretense command-line tool and local proxy server.
• "SaaS": Any hosted dashboard, API, or team management service provided by Pretense Inc.
• "User": Any individual or entity using the Services.

3. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Circumvent security controls or attempt unauthorized access to any system
• Transmit malware, viruses, or destructive code through the proxy
• Resell or sublicense SaaS services without prior written consent
• Use the Services for any purpose that would constitute export-controlled activity without proper authorization
• Scrape, reverse-engineer, or extract proprietary algorithms from the SaaS platform
• Impersonate Pretense Inc. or its employees in any context

4. Payment and Billing

Paid plans are billed monthly or annually in advance. All fees are in USD and non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' notice to active subscribers.

Payment is processed by Stripe. By providing payment information you authorize Stripe to charge your payment method on a recurring basis until cancellation.

5. Intellectual Property

Pretense retains all intellectual property rights in the platform, branding, and proprietary algorithms. You retain full ownership of any code you process through the local proxy. Pretense claims no rights to your source code or mutation outputs.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PRETENSE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRETENSE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL PRETENSE'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO PRETENSE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

8. Indemnification

You agree to indemnify and hold harmless Pretense Inc. and its affiliates from any claims, liabilities, damages, and expenses (including attorneys' fees) arising out of your use of the Services in violation of these Terms or applicable law.

9. Termination

Either party may terminate a subscription at any time. Pretense reserves the right to suspend or terminate access without prior notice for violations of the Acceptable Use policy. Upon termination, your right to use the SaaS services ceases immediately. Your Starter tier CLI license survives termination for continued individual use.

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.

11. Changes to Terms

We may update these Terms at any time. Material changes will be communicated with at least 30 days' notice via email to registered users. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
